Terms of Service — Pegas Tools

These Terms of Service govern your use of the Pegas Tools website (www.pegastools.com) and the purchase of digital products sold by VIKKY UNIPESSOAL LDA (“Pegas Tools”, “we”, “us”, or “our”). By placing an order or downloading a free product, you accept these Terms in full.

2. Products and Licences

Use of any Pegas Tools software — whether purchased, activated under a free licence, or used during a trial — constitutes acceptance of these Terms.

All products sold by Pegas Tools are digital goods — software add-ins for Autodesk Fusion 360 and a standalone Windows application. Upon purchase or free download, you receive a personal, non-exclusive, non-transferable licence to install and use the software on your own devices for professional or personal purposes.

  • You may not resell, sublicense, or redistribute the software.
  • You may not reverse-engineer, decompile, or modify the software.
  • Licences are tied to the individual purchaser and are not transferable to third parties.
  • Free add-ins may be used without restriction within the scope described on their product pages.

3. Prices and Taxes

All prices shown on the website are in EUR and exclude VAT unless stated otherwise.

  • Consumers (B2C) within Portugal and the EU: VAT at the applicable rate for Portugal (currently 23% IVA) will be added at checkout.
  • Business customers within the EU with a valid VAT number: VAT is not charged (EU reverse-charge mechanism, Article 196 of the EU VAT Directive). You are responsible for declaring the VAT in your own country.
  • Customers outside the EU: No VAT is charged.

4. Payment

Payment is processed securely at checkout. Orders are fulfilled automatically after successful payment. We do not store payment card details on our servers.

5. Digital Product Delivery

All products are digital goods delivered electronically — either as an immediate download link or via a download key provided in your order confirmation email. Physical delivery does not apply.

By completing your purchase and accessing the download, you expressly acknowledge that delivery of the digital content has begun and you waive your right of withdrawal as provided by Article 16(m) of Directive 2011/83/EU (Consumer Rights Directive). This does not affect your rights under our Refund and Returns Policy.

6. Refunds and Returns

Our refund terms are described in full in our Refund and Returns Policy. In summary: we offer refunds where the software fails to perform its described functionality and the issue cannot be resolved through support.

7. Intellectual Property

All software, documentation, graphics, and content on this website are the intellectual property of VIKKY UNIPESSOAL LDA and are protected by applicable copyright and intellectual property laws. Nothing in these Terms grants you any rights other than the limited licence described in Section 2.

8. Limitation of Liability

The software is provided “as is”. Pegas Tools makes no warranties — express or implied — as to fitness for a particular purpose, uninterrupted operation, or compatibility with specific third-party software versions beyond those described in the product documentation.

Pegas Tools software interacts with CAD geometry, manufacturing toolpaths and exported files. You are solely responsible for validating the correctness of outputs (sketches, bodies, toolpaths, DXF/SVG exports, generated G-code) before using them in production. We are not liable for any loss of data, damage to design files, machining errors, scrap material, downtime, or any direct, indirect, incidental, or consequential damages arising from use or inability to use our software. Maintain backups of your work.

To the maximum extent permitted by applicable law, our total liability for any claim arising from use of our products shall not exceed the amount you paid for the product giving rise to the claim.

9. Third-Party Software

Fusion 360 add-ins require a valid licence of Autodesk Fusion 360. Pegas Tools is not affiliated with, endorsed by, or in partnership with Autodesk Inc. Product functionality may be affected by updates to Autodesk Fusion 360; we aim to maintain compatibility but cannot guarantee it for all future versions.

10. Privacy

We collect and process personal data in accordance with our Privacy Policy and in compliance with the General Data Protection Regulation (GDPR).

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes take effect upon publication on this page. Continued use of the website or products after a change constitutes acceptance of the revised Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Portugal. Any disputes shall be submitted to the exclusive jurisdiction of the Portuguese courts, without prejudice to mandatory consumer protection provisions that may apply in your country of residence.

For out-of-court dispute resolution, EU consumers may use the European Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
